Medical debt has unique legal protections that most consumers dont know about. Recent changes at both the federal and state level have significantly improved protections for patients with medical debt.

Credit Reporting Changes

The three major credit bureaus now exclude medical debt under $500 from credit reports. Medical debt in collections does not appear on credit reports until it is at least 12 months old (giving you time to resolve disputes and payment issues). Paid medical collections are removed from credit reports. These changes, implemented in 2022-2023, have removed billions of dollars in medical debt from consumer credit reports.

What Debt Collectors Cannot Do

Under the Fair Debt Collection Practices Act (FDCPA), collectors cannot harass you with excessive calls, threaten you with jail, contact you at unreasonable hours, discuss your debt with others, or misrepresent the amount owed. You have the right to request debt validation, written proof that the debt is yours and the amount is correct. If you dispute a debt in writing within 30 days, the collector must verify it before continuing collection activities.

Strategies for Managing Medical Debt

Always verify the debt amount against your records. Apply for hospital financial assistance even after a bill goes to collections. Negotiate directly with the original provider whenever possible (they often accept 30-50 cents on the dollar). Request payment plans with no interest. Check if your state has specific medical debt protections. Many states have enacted additional consumer protections beyond federal law.
