1. Our Commitment

FairVisitHealth respects the intellectual property rights of others and expects users of our service to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement committed using the FairVisitHealth service that are reported to our Designated Copyright Agent.

2. Designated Copyright Agent

Notifications of claimed copyright infringement must be sent to our Designated Copyright Agent, registered with the U.S. Copyright Office:

3. Filing a DMCA Takedown Notice

If you believe that material available on or through FairVisitHealth infringes your copyright, you may request removal by sending a written notice to our Designated Copyright Agent. To be effective under the DMCA, your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner, or a person authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single online site are covered by a single notification, a representative list of such works.
  3. Identification of the material claimed to be infringing, and information reasonably sufficient to permit us to locate the material (e.g., a URL on fairvisithealth.com).
  4. Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and email address.
  5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Note: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees, incurred by the alleged infringer and by FairVisitHealth.

4. Filing a Counter-Notice

If material you posted was removed in response to a DMCA notice and you believe the removal was the result of a mistake or misidentification, you may file a counter-notice with our Designated Copyright Agent. To be effective, your counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, the District of Delaware), and that you will accept service of process from the person who provided notification of the alleged infringement or an agent of that person.

Upon receipt of a valid counter-notice, we will forward it to the original complaining party and may restore the removed material after 10 business days unless the complaining party notifies us that they have filed a court action seeking to restrain the alleged infringer.

5. Repeat-Infringer Policy

Consistent with 17 U.S.C. § 512(i)(1)(A), FairVisitHealth will terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. We may also, at our sole discretion, limit access to the service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

6. What Users May Upload

FairVisitHealth accepts limited user-submitted material — primarily images and PDFs of medical bills, Explanations of Benefits (EOBs), and receipts uploaded by the user for pricing analysis. By uploading, you represent that you own or have the necessary rights to upload the material and that doing so does not violate anyone else's copyright, contract, or privacy rights. Do not upload material you did not create or receive as the addressed patient.
